febrero, reguladora de la protecci\u00f3n de las personas que informen sobre infracciones normativas y de lucha contra la corrupci\u00f3n<\/a>.<\/p>\n<p>La finalidad de esta Ley es proteger a los ciudadanos que informen sobre vulneraciones del ordenamiento jur\u00eddico en el marco de una relaci\u00f3n profesional.<\/p>\n<p>Esta Ley se extiende tanto a administraciones p\u00fablicas como a personas f\u00edsicas o jur\u00eddicas del sector privado <strong>a partir de 50 empleados<\/strong>. mso-table-rspace: 0pt; -ms-text-size-adjust: 100%; -webkit-text-size-adjust: 100%; color: #606060; font-family: Helvetica; font-size: 15px; line-height: 150%; text-align: justify; padding: 0 18px 9px 18px;\" valign=\"top\"><span style=\"font-size: 14px;\"><span style=\"font-family: open sans,helvetica neue,helvetica,arial,sans-serif;\">A los <strong>informantes<\/strong>, es decir, a aquellos que trabajen en el sector privado o en el p\u00fablico y que hayan obtenido informaci\u00f3n sobre infracciones en un contexto laboral o profesional, comprendiendo lo siguiente:<br \/>\na) Personas que tengan condici\u00f3n de empleados p\u00fablicos o trabajadores por cuenta ajena, aut\u00f3nomos, accionistas, part\u00edcipes, cualquier persona que trabaje para o bajo la supervisi\u00f3n y la direcci\u00f3n de contratistas, subcontratistas y proveedores.<br \/>\nb) Personas que informen sobre infracciones obtenidas en el marco de una relaci\u00f3n laboral o estatutaria ya finalizada, voluntarios, becarios, trabajadores en periodos de formaci\u00f3n con independencia de que reciban o no remuneraci\u00f3n, e incluso aquellos que ni siquiera tengan a\u00fan una relaci\u00f3n laboral y hayan detectado cualquier anomal\u00eda durante un proceso de selecci\u00f3n o de negociaci\u00f3n precontractual.<\/span><\/span><\/p>\n<p><strong>Por lo tanto, esta Ley se extiende tanto a administraciones p\u00fablicas como a personas f\u00edsicas o jur\u00eddicas del sector privado a partir de 50 empleados.<\/strong><\/p>\n<p><u>El plazo para la implantaci\u00f3n de este sistema es de 3 meses desde la fecha de entrada en vigor de la Ley para las empresas con m\u00e1s de 249 personas en plantilla y hasta el 1 de diciembre de 2023 para las empresas con una plantilla de entre 50 y 249 trabajadores.<\/u><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><!-- [if mso]><\/td>\n\n\n<![endif]--><\/p>\n<p><!-- [if mso]><\/tr>\n\n\n<\/table>\n\n\n<![endif]--><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table class=\"mcnBoxedTextBlock\" style=\"min-width: 100%; Si la informaci\u00f3n se facilitase de forma verbal, en una reuni\u00f3n presencial, se deber\u00e1 advertir al informante de que la comunicaci\u00f3n ser\u00e1 grabada y <strong>se le informar\u00e1 del tratamiento de sus datos de acuerdo a lo establecido en el Reglamento (UE) 2016\/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, por lo que es imprescindible contar con un protocolo adecuado al uso del tratamiento de dichos datos para esta finalidad<\/strong><\/span><\/span><\/li>\n<\/ul>\n<div style=\"text-align: left;\"><span style=\"font-size: 14px;\"><span style=\"font-size: 14px;\"><span style=\"font-family: open sans,helvetica neue,helvetica,arial,sans-serif;\">El tratamiento de los datos personales en los canales de denuncia se considera l\u00edcito cuando sea obligatorio disponer del sistema de informaci\u00f3n al ser necesario para el cumplimiento de una obligaci\u00f3n legal.\u00a0<\/span><\/span><\/span><\/p>\n<p>El tratamiento\u00a0tambi\u00e9n se presume v\u00e1lido cuando el sistema no sea obligatorio, pero voluntariamente se decida crear uno, al ser necesario para la satisfacci\u00f3n del inter\u00e9s p\u00fablico. Adem\u00e1s, a quienes realicen la comunicaci\u00f3n a trav\u00e9s de canales internos se les informar\u00e1, de forma clara y accesible, sobre los canales externos de informaci\u00f3n ante las autoridades y, en su caso, ante las instituciones u organismos de la Uni\u00f3n Europea.<\/p>\n<p>Las comunicaciones verbales, incluidas las realizadas a trav\u00e9s de reuni\u00f3n presencial, telef\u00f3nicamente o mediante sistema de mensajer\u00eda de voz, deber\u00e1n documentar la informaci\u00f3n mediante una grabaci\u00f3n de la conversaci\u00f3n en formato seguro, duradero y accesible o a trav\u00e9s de transcripci\u00f3n realizada por el personal responsable de tratarla. Sin perjuicio de los derechos que le corresponden de acuerdo a la normativa de protecci\u00f3n de datos, se ofrecer\u00e1 al informante la oportunidad de comprobar, rectificar y aceptar mediante su firma la trascripci\u00f3n de la conversaci\u00f3n.<\/p>\n<\/div>\n<ul>\n<li style=\"-ms-text-size-adjust: 100%; -webkit-text-size-adjust: 100%;\"><span style=\"font-size: 14px;\"><span style=\"font-family: open sans,helvetica neue,helvetica,arial,sans-serif;\">Es importante saber que los canales internos de informaci\u00f3n permitir\u00e1n incluso la posterior tramitaci\u00f3n de comunicaciones an\u00f3nimas cuya comunicaci\u00f3n se hace a trav\u00e9s del <strong>Canal Externo de informaci\u00f3n<\/strong> ante la Autoridad Independiente de Protecci\u00f3n del Informante (A.A.I. o ante las autoridades u organismos aut\u00f3nomos correspondientes).<\/span><\/span><\/li>\n<li style=\"-ms-text-size-adjust: 100%; -webkit-text-size-adjust: 100%;\"><span style=\"font-size: 14px;\"><span style=\"font-family: open sans,helvetica neue,helvetica,arial,sans-serif;\">Se podr\u00e1 tambi\u00e9n <strong>revelar p\u00fablicamente en plataformas<\/strong> web, redes sociales, medios de comunicaci\u00f3n, etc, cuando los cauces internos y externos no hayan funcionado, cuando exista una amenaza inminente para el inter\u00e9s p\u00fablico o exista un riesgo de represalias o de un no tratamiento efectivo. En caso de que la empresa tenga p\u00e1gina web, el canal deber\u00e1 aparecer en la p\u00e1gina de inicio, en una secci\u00f3n separada f\u00e1cilmente identificable. <\/span><\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 14px;\"><span style=\"font-family: open sans,helvetica neue,helvetica,arial,sans-serif;\">Las empresas tendr\u00e1n que registrar las informaciones recibidas y sus investigaciones internas a trav\u00e9s del <u><strong>\u00f3rgano de administraci\u00f3n de la empresa<\/strong><\/u> que es el responsable de la implantaci\u00f3n del sistema, previa consulta con la representaci\u00f3n legal de las personas trabajadoras. <u><strong>Este registro no es p\u00fablico<\/strong><\/u>; \u00fanicamente a petici\u00f3n razonada de la<u> Autoridad judicial<\/u> competente podr\u00e1 accederse total o parcialmente al contenido del registro<\/span><\/span><\/p>\n<p>En cualquier caso, <strong>se debe garantizar la confidencialidad del alertador<\/strong> con la implementaci\u00f3n de sistemas de informaci\u00f3n, hacer un seguimiento continuo del estado de la informaci\u00f3n por parte del informante, acusar recibo por parte de la empresa u organizaci\u00f3n en el <u><strong>plazo de 7 d\u00edas <\/strong>a partir de la recepci\u00f3n de la informaci\u00f3n <\/u>y <u>realizar una evaluaci\u00f3n sobre la resoluci\u00f3n de la informaci\u00f3n en los siguientes 3 meses<\/u> tras haber interpuesto la informaci\u00f3n, salvo casos muy complejos cuyo plazo puede prorrogarse otros 3 meses.<\/p>\n<p>Todo ello est\u00e1 sujeto a la prohibici\u00f3n de cualquier represalia, la protecci\u00f3n no solo se extiende a los empleados de la empresa en cuesti\u00f3n, sino tambi\u00e9n a los familiares, amigos, socios comerciales y terceros entre otros. D<strong>ebe haber medidas objetivas para la protecci\u00f3n de los informantes contra todo tipo de represalia como el despido, el cambio de trabajo, discriminaci\u00f3n, coacci\u00f3n o acoso as\u00ed como se debe dar un apoyo al informante, asesor\u00e1ndole sobre los procedimientos y recursos disponibles, as\u00ed como asistencia jur\u00eddica si fuera necesario.<\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><!-- [if mso]><\/td>\n\n\n<![endif]--><\/p>\n<p><!-- [if mso]><\/tr>\n\n\n<\/table>\n\n\n<![endif]--><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table class=\"mcnBoxedTextBlock\" style=\"min-width: 100%;
